EMPLOYMENT and WORKPLACE DISPUTE RESOLUTION

Many companies and businesses spend thousands, if not millions, of dollars on defending and paying overtime wages, unemployment benefits, racial discrimination claims, sexual harassment claims, for personality conflicts, and many other types of employment related issues and claims. Many large corporations have mechanisms in place to deal with such issues early before the disputes escalate, but many small, medium sized and even large businesses do not have any such resource.

In todays workplace climate, businesses need to implement procedures and programs that mitigate future claims and damages before they cost the employer and the employees. As an example, take an unemployment wage claim. As many employers know, any terminated employee can file with the Department of Work Force Services (DWFS) for unemployment benefits. If DWFS finds that this employee was not terminated for “Just Cause” then the employer can be liable to pay thousands in unemployment wages for up to 48 weeks per employee.

By having proper dispute resolution mechanisms in place, both the employee and the employer are protected. The employee is ensured that he or she is not just terminated on the spot and without reason. The employee can rest assured that he or she will have an opportunity to plead his or her case or more fully explain the circumstances as he or she sees them before being terminated. The employer is protected in that it has provided a formal method to resolve the dispute with the employee. By showing that the employer has considered possible solutions to keep the employee by sorting things out and also exploring more fully why the employee is being considered for termination the employer can show the DWFS that the employee was clearly terminated for “Just Cause.” The result is less frivolous claims, happier employees and a huge savings in money and time.
